State Council Public Office Letter [2019] No. 51

We have received the "Letter on Issues Related to the Implementation of the Regulations of the People's Republic of China on Government Information Disclosure"(China Propaganda Office issued Letter [2019] No. 538). After in-depth research and fully soliciting opinions from the Central Organization and Comprehensive Bureau, the Administrative Law Office of the Legal Affairs Commission of the Standing Committee of the National People's Congress, the General Office of the Ministry of Justice, the Administrative Trial Division of the Supreme People's Court and other units, we now reply to relevant issues as follows:
1. According to the "Plan for Deepening the Reform of Party and State Institutions" and the "Notice of the State Council on Institutional Establishment"(Guo Fa [2018] No. 6), the State Council Information Office, the State Press and Publication Administration, the National Copyright Administration, and the National Film Administration have issued a new notice in the Central Propaganda Department. This is not only a major measure to strengthen the party's leadership, but also a concrete manifestation of adhering to administration according to law. In accordance with relevant legal provisions and work realities, units that independently perform statutory administrative functions in their own name are treated as administrative agencies in principle.
2. Starting from the actual situation of co-located offices, and fully considering the organic connection between party affairs disclosure and government information disclosure, in principle, the "Government Information of the People's Republic of China" shall apply to the information formed in the process of independently performing statutory administrative functions in its own name, and the "Regulations on the Disclosure of Party Affairs of the Communist Party of China (Trial)" shall apply to other information.
3. When releasing the annual report on government information disclosure work to the outside world, multiple signs added to the same party's working body may be released in a combined manner or separately according to actual conditions. If the national government information disclosure department has other special provisions on this, special provisions shall be followed.
4. If other party work organs add signs of administrative organs, refer to the above opinions.
