Opinions on handling foreign citizens, legal persons or other organizations applying to our administrative agencies for disclosure of government information
We have received the "Letter on Please Clarify whether it can accept applications for government information disclosure by foreign institutions and personnel stationed in China"(Development and Reform Office [2008] No. 1057). I hereby write to you as follows:
1. If foreign citizens, legal persons or other organizations within our country apply to our administrative agencies for obtaining relevant government information due to special needs such as production, life, and scientific research, our administrative agencies shall handle it in accordance with the relevant provisions of the Regulations of the People's Republic of China on Government Information Disclosure. If a foreign citizen, legal person or other organization outside our country submits an application for government information disclosure to our administrative agency, our administrative agency will not accept it.
2. After receiving an application from a foreign citizen, legal person or other organization within our territory for disclosure of government information, our administrative agency shall verify the identity of the applicant; the government information to be provided must be strictly reviewed in accordance with the Law on Protecting State Secrets and other laws, regulations and national regulations.
3. The government information provided by our administrative agencies to foreign citizens, legal persons or other organizations is generally in Chinese, and no foreign translation is provided.
Residents, legal persons or other organizations of the Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan apply to our administrative agencies for obtaining government information shall be handled in accordance with the above opinions.
